Dear Undergrads,
On April 25th, the UA Council voted to mandate a recall election of David Spicer as UA President. This will be run as a special election with the below schedule and provisions. Per the UA Constitution, ⅔ of voters must vote in favor of David’s removal for the recall to pass. Additionally, per the Election Code, the election will be announced 10 academic days before voting is opened and the Council has determined the election calendar.
April 30th: Announcement of Recall Election
May 1st (8am): Campaigning Begins
May 11 (8pm): Campaigning Closes
May 13th (8am): Voting Opens
May 14th (8am): Voting Closes
May 14th (by 11:59 pm): Results Announced
Per Article II, Section B3 of the Election Code, “The Commission shall be empowered to enact any special rules governing the election process.” With this power, The Election Commission has determined the following special rules, in addition to the Election Code, to govern this recall election
Note- All campaign policies for this election are attached in a campaign rule document
1. Campaigning for this election will be defined as:
* Anything promoting undergrads to vote one way or another in the recall election. This includes, but not limited, posters, chalk, social media, speeches, websites, and in-person events and conversations.
* All campaign material must be clearly and conspicuously attributed to the creator’s name.
* You may only campaign on email lists that you are a part of. Blind carbon copying (bcc) is not allowed. Thus, any dorm-spamming for or against the recall is not allowed.
* However, sending emails encouraging people to vote is permitted for as long as you are not providing a side to vote for.
2. Campaigning may not violate any MIT rule or policy or destructively interfere with the Election Commission’s job to run the election and preserve its integrity. All campaigning must remain civil and respectful.
3. Within a living group (dorm, frat, etc.), campaigns must follow all rules imposed by that living group (postering included). This provision will be enforced by the group’s governing body, which may request an Election Commission investigation.
4. Bribery of voters is not allowed. Bribery is defined as the application of such influences [giving or accepting money or some other payment] in exchange for votes.
5. All undergraduates at MIT are to be held to the campaign rules. Any campaigning violations can be reported to the Election Commission by any member of the undergraduate population. Official complaints must be emailed to ua-elect at mit.edu. Only officially filed complaints will be considered.
6. A list of substantiated complaints filed against anyone who violated campaign rules shall be available on the online voting system if the complaints are received and investigated prior to 12 hours before voting opens.
7. If someone is unsure if a particular activity violates election rules, they shall contact the Election Commission for an official interpretation.
Note: David Spicer is not being considered as an “official candidate” as described in the Election Code. “Official candidates” are those who are seeking office. For this recall election, there are no official candidates. The recall election is a vote to remove or not remove someone from office. All language in the Election Code that refers to “official candidates” is thus not applicable for this Election, including funding for any candidate. We have made this determination under our power as the Election Commission to interpret the Election Code, as given in Article II, Section B2 of the Election Code.
