You could also do a restore of the existing OS through iTunes. But if I had a phone that was giving me that many problems, if a restore didn't fix it, an upgrade to 4.1 didn't fix it, I would make my way to the Apple store. Or, if the phone wasn't under warranty, buy a replacement.
